Chapter 20 - SENTENCE

The judge sentenced Marcella to fourteen months in custody on the felony scheme count, with other financial counts running under the structured sentence, followed by supervised release and charitable-fiduciary restrictions.
Not ten years.
Not probation only.
Fourteen months.
Restitution already largely satisfied through civil settlement was credited appropriately rather than double-charged.
She could not serve as director, officer, or financial decision-maker for a charitable organization during supervision.
Separate misdemeanor assault case for striking Vivia resulted in probation conditions and no direct contact without my consent and therapist approval.
The judge did not call Marcella evil.
He said:
“You were not prosecuted for failing to volunteer. You were prosecuted because you chose secret compensation while occupying a position that required disclosure.”
Then:
“Your charitable work is real. So is the breach.”
Both.
Marcella spoke.
She apologized to foundation.
Then:
“I spent years believing that because I brought money in, I was entitled to take some out in ways I did not have to explain.”
Specific.
Then:
“I was wrong.”
Good.
Then Vivia.
Marcella did not address her publicly because the child case had its own boundaries.
Good.
Then me.
Marcella said:
“My brother failed to supervise me. I used that failure.”
My chest tightened.
Then:
“That does not make what I did his crime.”
There.
Important.
Then Elena.
“I hated her for making me answer questions.”
No speech to dead woman.
Fine.
Custody began several weeks later after self-surrender date.
No handcuffs in front of Vivia.
No family spectacle.
Then foundation board sent statement:
The criminal case does not conclude our governance work.
Good.
Compliance monitors.
Independent directors.
Public vendor disclosures.
No Bellandi seats during three-year period.
Then donors returned slowly.
Some never did.
Foundation annual giving fell twelve percent first year.
Programs adjusted administrative costs, not core emergency grants.
No magical immunity from scandal.
Then my own role.
I remained CEO of Bellandi Holdings but stepped away from foundation completely.
Rafe stayed.
Family dinners remained smaller.
Some relatives reconciled.
Some called me traitor.
Fine.
Then Marcella’s apartment sale? She sold a vacation home to cover settlement and legal costs. Not impoverished.
Then Adrian remarried? Too soon. No.
Then Vivia asked to see Marcella in prison.
I said no initially.
Dr. Kline asked:
“Why?”
“She hit her.”
“Yes.”
“She used her dress.”
“Yes.”
“What does Vivia want?”
“She wants to ask about Mom.”
Important.
Marcella had known Elena longer than Vivia remembered.
Could contact help?
Maybe later.
We waited.
No rush.
Then Vivia said:
“I don’t want prison. I want phone.”
Supervised call.
Marcella’s counsel and facility rules could allow.
After therapist preparation, one ten-minute call.
Marcella:
“Hi, Viv.”
Vivia:
“Why did you hate Mom?”
Marcella closed her eyes.
“I was jealous of her.”
“Why?”
“She could tell your dad no and still know he loved her.”
Vivia frowned.
“That dumb.”
Marcella laughed.
“Yes.”
Then:
“Did Mom hate you?”
“No.”
“How know?”
“Because she kept giving me chances to tell the truth.”
I looked away.
Then Vivia:
“Why slap me?”
Marcella’s face broke.
“Because you looked like her and I was angry. That was not your fault.”
“Don’t again.”
“I won’t.”
Ten minutes.
Done.
No hug.
No forgiveness.
Then Vivia asked:
“Can Aunt Cella come home after jail?”
“Her home, yes.”
“Ours?”
“Not automatically.”
Good.
Then Elena’s USB remained with court evidence custodian during appeal period.
Marcella did not appeal conviction broadly? She filed appeal on evidentiary issue, standard.
No immediate closure.
Then appellate court months later upheld core convictions and audio admission.
One minor record count vacated? Could make precise. Let's save later.
The legal storm was shrinking.
But the Bellandi family had one unresolved issue bigger than sentence:
My father’s old structures still allowed family members to sit on boards, approve vendors, and call verbal understandings “disclosure.”
May you like
If we changed nothing, Marcella would become a scandal we survived instead of a system we learned from.
That would be another form of hiding the USB.
