Chapter 18 - THE VERDICT
The jury convicted Harrison of:
Conspiracy to defraud the financial institution.
False electronic/business records tied to the professional certifications.
One count of obtaining credit through material misrepresentation.
They acquitted him on a broad theft-related theory tied to the full $3.4 million overadvance.
Why?
Most borrowed money went to legitimate company uses.
Prosecutors had not proven he intended to permanently deprive Hartwell of all funds.
Good.
They also acquitted one count involving a Northpoint transfer because board authority language was ambiguous.
Again.
Specific.
Harrison was not a man who stole $14.8 million.
He was a CEO who used a false professional certification to keep access to credit while concealing a covenant problem and related-party exposure.
That was serious enough without exaggeration.
Sentence:
Custodial term.
Financial penalties.
Restitution for documented lender and professional costs where legally recoverable.
Permanent bar from executive or fiduciary control at Whitmore Development under civil settlement and governance agreements.
His shares remained his.
Dividends subject to ordinary rights and restitution obligations.
No poverty theater.
He lived comfortably after release.
Just not as king.
At sentencing Harrison looked at me.
Not Evan.
Me.
“I never wanted you hurt.”
I believed him.
That was almost worse.
“You wanted to use me.”
He did not answer.
The judge did not allow conversation to become theater.
Good.
Then Evan spoke only in a victim-impact context? He wasn't direct financial victim. Better no.
Outside, a reporter asked me:
“Do you forgive Harrison?”
“No idea.”
“Do you think Lucas should have received more time?”
“That is not my job.”
“Did your pregnancy save the case because the recording was so shocking?”
“No.”
The recording saved itself because Lucas forgot it was running while he committed a crime.
